EACH calls for loosening of cloud regulations for EU clearing firms

The European Association of Central Counterparty Clearing Houses (EACH) has called for changes to proposed European rules regulating cloud services. The EU Cybersecurity Certification Scheme for Cloud Services (EUCS) is a voluntary scheme that includes provisions restricting the ability to use cloud service providers based on where they are located and their data is stored or processed. The EACH has concerns about the geographical restrictions, which would undermine central counterparties’ (CCP) ability to manage their operational and cyber risk effectively. Under current considerations, CCPs would be forced to exit longstanding contracts with existing non-EU based cloud service providers without a suitable alternative.
